1. LaFacha Bet

1.1. The LaFacha Bet platform, accessible via the website lafacha.bet and its subdomains, applications and other official channels (the "Platform"), is operated under the LaFacha Bet brand (hereinafter "LaFacha Bet", "Operator", "we" or "our").

1.2. These Terms of Service ("Terms") govern access to and use of the Platform and all sports betting products, casino, live games and other services made available on it (the "Services").

2. Important notice

2.1. By registering and using the Platform, you enter into a contract with LaFacha Bet and agree to comply with: (i) these Terms; (ii) our Privacy Policy; (iii) our Responsible Gaming Policy; and (iv) the specific rules of each game, bet, bônus or promotion made available on the Platform, which form part of these Terms.

2.2. Please read these Terms carefully. If you have any questions about your rights and obligations, we recommend consulting a legal advisor in your jurisdiction before using the Platform. If you do not agree to these Terms, do not use, visit or access any part of the Platform.

3. General provisions

3.1. By registering on the Platform, you ("User", "you" or "Player") enter into a legally binding contract with LaFacha Bet.

3.2. These Terms come into force when you complete registration, which includes ticking the acceptance box for these Terms and successfully creating your account.

3.3. LaFacha Bet may amend these Terms at any time. Material changes will be communicated with reasonable advance notice by email, account notification or a prominent notice on the Platform. Continued use of the Services after the changes take effect will be deemed acceptance of the new version. If you do not agree to the changes, you may close your account and withdraw the available balance, in accordance with these Terms.

3.4. In the event of a conflict between these Terms and the rules of games or other documents referred to in these Terms, these Terms shall prevail, unless expressly stated otherwise.

3.5. These Terms may be made available in multiple languages to facilitate access. In the event of any discrepancy between versions, the Portuguese version shall prevail.

4. LaFacha Bet account

Registration

4.1. To place bets on the Platform, you must first register an account in person ("Account").

4.2. The request to open an Account must be made in person by the account holder and requires the provision of personal data such as full name, date of birth, address, email, telephone number and identification document.

4.3. If the required information is not provided or is not complete, correct and up to date, LaFacha Bet may suspend the Account and subject deposits, bets and winnings to verification procedures, in accordance with section 9. In this case, please contact support at lafachabet@gmail.com.

4.4. Only persons aged 18 or over, or the minimum legal age for betting applicable to the User, if higher, may register. LaFacha Bet may request proof of age at any time and suspend the Account until satisfactory documentation is provided. Accounts belonging to minors will be closed immediately.

4.5. LaFacha Bet will not accept registration from persons who:

a) are under 18 years of age or the applicable minimum legal age, if higher;
b) reside or are located in jurisdictions where online betting is prohibited or unauthorised. It is the User’s sole responsibility to ensure that use of the Services is lawful in their jurisdiction;
c) provide false or misleading information or attempt to impersonate third parties;
d) are self-excluded from any betting operator or listed on applicable betting prohibition registers.

4.6. LaFacha Bet may refuse any request to open an Account at its discretion.

Know Your Customer (KYC)

4.7. You declare and warrant that all information provided during registration is true, complete and up to date, and undertake to keep it up to date.

4.8. LaFacha Bet may, at any time, request documents and information it deems necessary to confirm the User’s identity, location, ownership of payment methods and source of funds, and the provisions of section 9 shall apply while verification is pending. LaFacha Bet may share User information when required by law, by a competent authority or as set out in the Privacy Policy.

Multiple accounts

4.9. Only one Account per User is permitted. Opening or attempting to open more than one Account, in one’s own name or in the name of third parties, or using another person’s Account, authorises LaFacha Bet to suspend or close all Accounts involved and to void bets and bônus obtained through such practice.

4.10. If there are indications of multiple accounts or collusion between Users, LaFacha Bet may treat the Accounts involved as multiple accounts and suspend them, subjecting the respective balances to the verification procedures in section 9 until the situation is clarified.

4.11. If you realise you have more than one registered Account, you must notify us immediately.

User responsibility

4.12. You are solely responsible for keeping your login details secure and must not share them with anyone.

4.13. LaFacha Bet is not responsible for unauthorised use of the Account by third parties resulting from the disclosure, intentional or otherwise, of your login details.

4.14. It is prohibited to sell, transfer or acquire Accounts from other Users.

4.15. You must notify us as soon as you become aware of any error in your Account or in the calculation of any bet. LaFacha Bet may void bets affected by an error, in accordance with section 19.

4.16. You are responsible for all activity on your Account.

Security features

4.17. We recommend enabling two-factor authentication, when available, and using any other security features we offer.

Suspension and closure by LaFacha Bet

4.18. LaFacha Bet may suspend or close the Account if:

a) it considers that you are using or have used the Platform fraudulently, in collusion or for unlawful or improper purposes;
b) it considers that you are using or have used the Platform unfairly, have deliberately cheated or obtained an undue advantage, or that the Account is being used for the benefit of third parties;
c) there is an order from a police, judicial or regulatory authority, or it is not possible to verify your identity, location or the source of your funds;
d) you breach these Terms, applicable law or the fair use of the Services, or there are indications that you are exhibiting problem gambling behaviour;
e) there are reasonable indications that any of the above situations has occurred or is about to occur.

4.19. In the situations set out in item 4.18, LaFacha Bet may void bets placed in breach of these Terms and take the measures provided for in section 9. Legitimately available funds will not be forfeited automatically; their release remains subject to the completion of the relevant verifications and applicable legal and regulatory provisions. Funds proven to have been obtained by fraud, collusion or breach of these Terms may be voided or reversed, within the limits of the law.

4.20. To the extent permitted by applicable law, you shall be liable for direct damages, costs and expenses demonstrably incurred by LaFacha Bet as a result of the conduct described in item 4.18.

4.21. LaFacha Bet may suspend the Account, with or without prior notice, if there is suspicion that it has been compromised or is being used in breach of these Terms.

4.22. In the event of Account closure, LaFacha Bet will inform you of the means available to withdraw the remaining legitimately available balance, after completion of the applicable verifications.

Closure by the User

4.23. You may request closure of your Account at any time via support. Self-exclusion requests are governed by our Responsible Gaming Policy.

5. User representations and warranties

5.1. Before and throughout the use of the Services, you represent, warrant and agree that:

Capacity

a) you are 18 years of age or older, or the applicable minimum legal age, if higher;
b) you have full civil capacity to enter into this contract;
c) you are not self-excluded from any gaming site or establishment and will notify LaFacha Bet immediately if you become self-excluded;

Jurisdiction

d) you access the Platform from a jurisdiction where this is permitted and will not use the Services while located in a jurisdiction that prohibits online betting, casino or live games;
e) you acknowledge that LaFacha Bet may use means to detect and prevent prohibited techniques, including device analysis, geolocation, IP masking, transaction analysis and blockchain analysis;

Funds and taxes

f) you are solely responsible for declaring and paying any taxes due on your winnings, in accordance with applicable law;
g) you acknowledge that there is a risk of losing money, including cryptoassets where applicable, when using the Services;
h) you will not deposit funds of illicit or unauthorised origin;
i) you will use only payment methods in your own name for deposits and withdrawals;
j) you will use deposited funds exclusively for the Services on the Platform;
k) you acknowledge that the value of cryptoassets, where accepted, may fluctuate significantly, and that LaFacha Bet is not a financial institution;

Other

l) you use the Services of your own free choice and at your own risk;
m) you will not engage in unlawful activities through the Account;
n) all information provided is true and will be updated whenever there is a change;
o) you participate in games only for personal, recreational and non-professional purposes, in your own name and not on behalf of third parties;
p) you have only one Account;
q) you acknowledge that telecommunications networks and internet services are beyond LaFacha Bet’s control;
r) you will not engage in fraud, collusion, result manipulation or any other unlawful activity, nor use software, bots or devices that give you an unfair advantage;
s) you will not bet on events about which you hold privileged information or which you may influence, including, but not limited to, athletes, coaches, referees, officials, owners (direct or indirect, holding 10% or more) of entities or teams involved, and persons involved in setting the odds for those competitions.

5.2. In the event of a breach of any of these representations, LaFacha Bet may suspend or close the Account and void affected bets, to the extent permitted by law, in accordance with item 4.19.

6. LaFacha Bet’s commitments

6.1. LaFacha Bet undertakes to:

a) manage User funds securely and appropriately;
b) process User personal data in accordance with applicable law and the Privacy Policy;
c) provide responsible gaming tools.

6.2. The Platform and software are provided "as is". To the maximum extent permitted by law, LaFacha Bet does not warrant that the Platform will meet all your expectations, operate without errors or interruptions, have all defects corrected or be free of viruses.

6.3. LaFacha Bet can be contacted at lafachabet@gmail.com or via chat, when available. Abusive, offensive or discriminatory conduct towards our staff or partners may result in suspension or closure of the Account.

7. Deposits

7.1. You may only participate in games if you have sufficient balance in your Account. LaFacha Bet does not grant credit for betting.

7.2. Deposits must be made using the payment methods available on the Platform, exclusively with your own funds and using payment methods in your own name.

7.3. You must ensure that deposited funds are not of illicit origin.

7.4. You must deposit funds only for the purpose of betting on the Platform. If there are indications of deposits made without the intention to bet, LaFacha Bet may take the measures in section 9 and report the activity to the competent authorities, where applicable.

7.5. If LaFacha Bet identifies deposits made with third-party payment methods or funds of illicit origin, it may suspend or close the Account and cancel, reverse or adjust the transactions and any winnings arising from them, in accordance with section 9 and applicable law.

7.6. Minimum and maximum deposit amounts, available payment methods and any fees are displayed on the Platform and may be changed. Some payment methods may not be available in all countries, and your bank or payment provider may charge its own fees, including currency conversion fees.

7.7. LaFacha Bet is not responsible for delays caused by payment providers or third parties.

7.8. LaFacha Bet may apply additional procedures to verify your identity when processing deposits.

7.9. It is not permitted to transfer balance to another User’s Account.

7.10. LaFacha Bet may refuse deposits at its discretion. Users with a blocked or suspended Account must not make deposits; deposits received in such circumstances will be subject to the procedures in section 9 and, if legitimate, returned or released after verification is completed.

8. Withdrawals

8.1. LaFacha Bet may condition any withdrawal on:

a) verification of the User’s identity and confirmation that the request is made by the Account holder;
b) transfer to an account or wallet in the User’s own name;
c) submission of any additional information and documents requested;
d) compliance with the minimum activity requirement, whereby the amount of each deposit must be wagered at least once (1x) before withdrawal, as a measure to prevent money laundering.

8.2. LaFacha Bet may investigate the Account and gaming activity and, if there are indications of a breach of these Terms or the law, apply the measures in section 9, including in relation to deposits, withdrawals and bets, during the investigation.

8.3. Withdrawals must be made using the same payment method used for the deposit, unless this is impossible or LaFacha Bet decides otherwise. If deposits were made using different methods, LaFacha Bet may split the withdrawal between them, in accordance with its AML/CFT policies.

8.4. If funds are credited to the Account in error due to a technical or human mistake, they do not belong to the User and will be reversed. If such funds have already been withdrawn, they will constitute a debt owed by the User to LaFacha Bet. You must notify us immediately if you notice an erroneous credit.

8.5. Minimum withdrawal amounts and any fees are displayed on the Platform. LaFacha Bet is not responsible for fees charged by third parties such as banks or payment providers.

8.6. If there are multiple pending withdrawals, LaFacha Bet may request that they be consolidated into a single request.

8.7. Withdrawals in cryptoassets, when available, will be made to the wallet address indicated by the User in a valid request.

8.8. Users wishing to recover the balance of a closed, blocked or self-excluded Account must contact lafachabet@gmail.com.

9. Limitation, suspension and verification of financial transactions

9.1. The Operator reserves the right, at any time, based on its own criteria for evaluation, monitoring, security, regulatory compliance and risk management, to establish, review, reduce or apply operational limits, as well as to temporarily suspend, restrict or subject to additional verification procedures any deposit, withdrawal, transfer or financial movement carried out by the User, individually or cumulatively, whenever it identifies circumstances that, in its technical and reasoned judgement, justify the adoption of preventive or corrective measures.

9.2. Such measures may be adopted, among other situations, as a result of registration, banking, financial or transactional inconsistencies; discrepancies in ownership; the need to validate the origin or destination of funds; identification of atypical betting or financial movement patterns; suspicions of fraud, platform abuse, tax or fiscal irregularities, currency evasion, money laundering, terrorist financing or any other situations related to internal policies for the prevention of money laundering and terrorist financing (AML/CFT), Know Your Customer (KYC) procedures, transactional monitoring, operational integrity or compliance with legal and regulatory obligations.

9.3. The Operator may, within the limits of applicable law, take such measures preventively, including before the conclusion of internal investigation procedures, and is not obliged to disclose to the User the full extent of its monitoring parameters, analysis methodologies, risk indicators or information protected by legal confidentiality obligations, especially when disclosure could compromise the effectiveness of mechanisms for preventing, detecting or investigating irregularities.

9.4. The application of the measures provided for in this clause shall not, by itself, imply recognition of unlawful conduct by the User, nor shall it constitute a waiver, definitive retention or automatic loss of legitimately available funds; their release, restitution or movement remains subject to the completion of the relevant verification procedures and applicable legal and regulatory provisions.

9.5. The Operator may also request additional documents, information or clarifications, carry out further enquiries and report suspicious transactions to the competent authorities, where applicable, reserving the right to maintain restrictions for the period legally permitted and strictly necessary to complete verifications or comply with legal, regulatory or competent authority requirements.

10. Protection of funds and chargebacks

10.1. Deposited funds and winnings are held in segregated accounts or wallets intended exclusively for placing bets and settling fees related to the Services.

10.2. If LaFacha Bet suffers chargebacks, cancellations or payment refusals attributable to the User, it may recover the respective amounts and costs.

10.3. LaFacha Bet may offset the positive balance of the Account against amounts owed by the User to LaFacha Bet, to the extent permitted by law.

11. Placing bets

11.1. You may bet on the markets and products offered on the Platform. LaFacha Bet is not obliged to accept any bet, and a bet is only valid after confirmation of its acceptance.

11.2. Only bets placed online (including mobile devices) are accepted. Bets received by any other means are void.

11.3. It is your responsibility to check the details of the bet before confirming it. Once placed, a bet cannot be cancelled by the User, except via an edit feature, when available. LaFacha Bet may only cancel or amend a bet if the event is suspended or cancelled, if there is an obvious error in the bet or the odds, if the bet breaches these Terms, or if required by law or regulation.

11.4. Funds are allocated to bets in the order they are placed and are not available for any other use.

11.5. The return to player (RTP) and the rules of each game are provided by the respective supplier. If you have any questions or discrepancies, contact support before placing a bet.

12. Bet confirmation

12.1. Bets are only valid after confirmation of acceptance. Bets placed without sufficient balance are void.

12.2. Each valid bet receives a unique transaction code. If you have any doubt about the validity of a bet, check your Account history or contact support.

12.3. In the event of a discrepancy regarding the content of a bet, LaFacha Bet’s system transaction records shall be the primary reference, without prejudice to the User’s right to file a complaint under section 25.

13. Bônus and promotions

13.1. LaFacha Bet may offer, at its discretion, bônus and promotions, each subject to its own rules published on the Platform, which prevail for that offer.

13.2. By activating a bônus or promotion, you agree to its respective rules. Bets are placed first with real-money balance and then with bônus balance, unless a specific rule states otherwise.

13.3. Bônus and promotions have an expiry period defined in their rules. Expired, cancelled or deactivated bônus cannot be reactivated. Amounts from bônus already converted into real-money balance remain available.

13.4. LaFacha Bet may terminate or change bônus and promotions at any time, without prejudice to bônus already granted and in use in accordance with the applicable rules.

13.5. If there are indications of bônus abuse, including the use of multiple accounts, collusion or bad faith, LaFacha Bet may deny, cancel or remove bônus and any winnings derived from them, and suspend the Account, in accordance with item 4.19.

13.6. Self-excluded or paused Users do not receive bônus offers.

14. Prohibited uses

14.1. Personal use. The Services are intended exclusively for the User’s personal and recreational use.

14.2. AML/CFT and sanctions. Use of the Services for money laundering, terrorist financing, violation of international sanctions or any unlawful activity is expressly prohibited. The Services are not offered to persons or entities subject to sanctions or international restrictive lists, and by using them you declare that you are not in such a position.

14.3. Restricted jurisdictions. It is prohibited to use the Services from jurisdictions where online betting is illegal or unauthorised, or from jurisdictions designated by LaFacha Bet as restricted. The restriction applies to residents and to any person while located in those jurisdictions.

14.4. Any attempt to circumvent geographic restrictions, including the use of VPN, proxy or similar services, or the provision of false information about your location or residence, constitutes a serious breach of these Terms.

15. Your equipment

15.1. Your computer, mobile device and internet connection may affect the performance of the Platform. LaFacha Bet is not responsible for failures arising from your equipment, connection or internet or telephony provider.

15.2. LaFacha Bet is not responsible for damage to the mobile device, loss of data or data and call charges arising from use of the Platform.

15.3. The experience on mobile devices may differ from the desktop version.

16. Fair use

16.1. The Platform may only be used for recreational purposes, by placing bets on events and gaming products.

16.2. It is prohibited to use the Platform for the benefit of third parties or for unlawful, defamatory, abusive, obscene, discriminatory, fraudulent or dishonest purposes. LaFacha Bet may report any suspicious activity to the authorities.

16.3. If there is reasonable suspicion of fraudulent, dishonest or criminal acts, LaFacha Bet may take the measures in section 9 and any applicable legal measures.

16.4. LaFacha Bet will not accept or process bets when this is prohibited by applicable law.

17. Software and technology

17.1. Some game providers may require you to accept additional terms to use their products. LaFacha Bet is not responsible for third-party software.

17.2. We grant you a personal, non-exclusive and non-transferable right to use the Platform solely to access the Services, in accordance with these Terms. This right ends upon cancellation of the Account.

17.3. It is prohibited to: (a) make the Platform software available to third parties, sublicense, assign, rent or copy it; (b) access or attempt to access systems without authorisation or circumvent security mechanisms; (c) use bots, scrapers or automated tools; (d) reverse engineer, decompile, modify or create derivative works from the Platform; and (e) introduce viruses or other malicious code, or carry out denial-of-service attacks.

17.4. The Platform software belongs to LaFacha Bet or its suppliers and is protected by intellectual property rights.

17.5. In the event of a system or communication error affecting account settlement or game operation, LaFacha Bet may suspend the affected products and take the necessary measures to correct the error.

17.6. LaFacha Bet may alter, suspend or discontinue any part of the Platform and is not responsible for temporary unavailability.

18. Third-party content

18.1. The Platform may contain data, comments and content from third parties, as well as links to external websites, provided solely for your information. LaFacha Bet does not control such content and is not responsible for it.

19. Errors

19.1. LaFacha Bet may void or correct bets affected by obvious errors, including: (i) an obvious error in odds, handicaps, totals or cash-out values; (ii) acceptance of bets on closed or suspended markets; (iii) incorrect calculation or payment of settlement; or (iv) failure of the random number generator or payout tables of any game. LaFacha Bet shall not be liable when the User, in bad faith, attempts to benefit from such errors.

20. Breach and indemnification

20.1. Without prejudice to other rights, if the User breaches these Terms in whole or in part, LaFacha Bet may take such measures as it deems appropriate, including termination of this contract and any applicable legal measures.

20.2. To the extent permitted by law, you agree to indemnify LaFacha Bet, its directors, employees and partners against claims, damages, losses, costs and expenses, including legal fees, arising from: (a) breach of these Terms; (b) breach of law or third-party rights; or (c) misuse of the Services.

21. Limitation of liability

21.1. To the maximum extent permitted by law, LaFacha Bet shall not be liable for indirect, incidental, special or consequential damages, including loss of profits, arising from the use or misuse of the Services.

21.2. Nothing in these Terms excludes or limits LaFacha Bet’s liability in circumstances where the law does not permit such exclusion or limitation, nor does it affect any non-waivable rights of the User under applicable consumer protection legislation.

22. Intellectual property

22.1. LaFacha Bet and its licensors are the sole owners of all rights in the Platform, including code, structure, trademarks, domain names, images, graphics, videos, music, text and other content. It is prohibited to copy, distribute, publish, modify or use such content without prior written authorisation.

22.2. Use of the Services does not transfer to the User any rights in the Platform’s trademarks or content. You must notify us immediately if you become aware of any unauthorised use.

23. Responsible gaming

23.1. LaFacha Bet provides tools for deposit, loss, bet and time limits, pause and self-exclusion, described in the Responsible Gaming Policy. Play only for entertainment and with amounts you can afford to lose.

24. Privacy

24.1. The processing of your personal data is governed by the Privacy Policy, which forms part of these Terms.

25. Complaints and disputes

25.1. Complaints about the Services must be sent to support at lafachabet@gmail.com or via chat, when available, with a description of the incident, date, time and Account identification. LaFacha Bet will review the complaint and respond as soon as possible.

25.2. If the complaint is not resolved satisfactorily, the User may resort to the remedies provided for in applicable law.

26. Changes

26.1. LaFacha Bet may update these Terms or change the Services, in accordance with item 3.3. We recommend checking the current version periodically.

27. Governing law

27.1. These Terms are governed by the law applicable to the Operator, without prejudice to mandatory consumer protection rules of the User’s country of residence, where applicable.

28. Final provisions

28.1. Severability. If any provision of these Terms is held to be illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect.

28.2. Assignment. LaFacha Bet may assign this contract, in whole or in part. The User may not assign their rights or obligations without prior authorisation.

28.3. Waiver. LaFacha Bet’s tolerance of any breach of a provision shall not constitute a waiver of the right to require its performance.

28.4. Third parties. These Terms do not confer rights on third parties and do not create a partnership, agency, representation or employment relationship between the User and LaFacha Bet.

28.5. Entire agreement. These Terms, together with the documents referred to herein, constitute the entire agreement between you and LaFacha Bet regarding the Services.
